We reserve the right to update or revise these Terms at any time, with or without notice. Your continued use of the Site or our services after changes are posted constitutes acceptance of the revised Terms.

1. Definitions

  • Company: Refers to Team of Roadside Service, its affiliates, authorized staff, technicians, drivers, and service partners.

  • Customer: Refers to any individual or entity that accesses this Site, or requests, books, schedules, or receives towing or roadside assistance services.

  • Site: Refers to the website, digital contact forms, and online communications platforms operated by the Company.

2. Service Acceptance & Contract Formation

When a Customer books, schedules, or confirms a service request with Team of Roadside Service—whether online, by phone, text message, or email—the Customer acknowledges that they have carefully read, understood, and agreed to these Terms and Conditions.

  • Binding Agreement: Confirmation of service constitutes a binding agreement, even if no physical signature is provided.

  • Scope of Service: The Company agrees to tow, transport, or provide roadside assistance for the customer’s vehicle to the location designated at the time of booking. If no drop-off location is specified, the vehicle will be moved to a safe and suitable storage site at the Customer’s expense until further written instructions are received.

  • Informational Disclaimer: Content on this Site is provided for general informational and dispatch purposes only and does not constitute formal legal, mechanical, or insurance advice.

3. Service Rates, Billing, and Storage

  • Standard Rates: Customer agrees to pay standard service charges based on mileage, vehicle type, labor, time of day, and location.

  • Storage Fees: Daily storage fees apply to any vehicle stored at our facility or affiliated partner lots. Current daily storage rates are available upon request.

  • Dispute Limitations: Customers may not withhold or delay payment due to any claim, dispute, or pending insurance determination related to the service.

4. Payment Policy

Unless otherwise agreed upon in writing prior to service dispatch:

  • Payment Method: Full payment must be processed via cash, valid credit card, or debit card immediately upon issuance of an invoice or completion of service.

  • Late Payments: Delayed payments are subject to late fees and interest charges accrued at the maximum rate permitted under state and U.S. lending limits.

  • Refunds & Cancellations: Service cancellations and refund requests are governed by our standard cancellation procedures to ensure fair compensation for dispatched drivers.

5. Customer Responsibilities & Ownership Warranties

Prior to requesting service, the Customer warrants and agrees to the following:

  • Authority: The Customer certifies that they are the legal owner of the vehicle or have full explicit authority from the legal owner to authorize towing, winching, entry, or roadside services.

  • Indemnification: The Customer agrees to defend, indemnify, and hold harmless Team of Roadside Service against any third-party claims, disputes, or liabilities arising from unauthorized service requests or ownership disputes.

6. Lien Policy & Right to Hold Vehicle

To secure unpaid service charges, towing fees, and storage costs, Team of Roadside Service maintains a legal lien on any vehicle towed, transported, or stored:

  • 90-Day Unclaimed Vehicle Policy: If a Customer fails to pay outstanding balances or retrieve their vehicle within 90 days of service, the Company reserves the right to sell the vehicle at public or private sale in accordance with applicable state and U.S. towing and lien laws.

  • Proceeds of Sale: Proceeds will be applied toward outstanding towing, labor, administrative, and storage fees. Any remaining balance will be refunded to the Customer upon written request within 30 days of the sale.

  • Liability Exemption: Team of Roadside Service bears no liability for any perceived value loss or damage resulting from the lawful execution of a lien sale.

7. Limitation of Liability & Disclaimers

Every towing and roadside assistance event is carried out with professional care. However, vehicles are transported and serviced at the Customer’s request. To the fullest extent permitted by law:

  • Site & Service “As Is”: This Site and all provided services are delivered on an “as is” and “as available” basis without express or implied warranties.

  • Property Loss or Damage: Team of Roadside Service is not liable for theft, loss, or damage to any vehicle, its contents, or personal belongings left inside the vehicle during towing or storage.

  • Unforeseen Delays: The Company is not responsible for service delays, late arrivals, delivery to incorrect secondary locations, or inability to perform service resulting from acts of God, severe weather, road closures, traffic congestion, or third-party negligence.

  • Consequential Damages: The Company disclaims all liability for direct, indirect, incidental, or consequential financial losses, personal injury, or vehicle downtime regardless of whether claims arise from contract, negligence, or other legal theories.

8. Privacy Policy & Consent to Be Contacted

We maintain a Privacy Policy governing the collection, use, and protection of personal information. By using this Site or requesting service, you consent to our privacy practices.

By submitting your details via website forms, text, or phone calls, you expressly request information and consent to be contacted via:

  • Automated or manual telephone calls

This consent applies even if your telephone number is listed on a federal or state Do-Not-Call registry.

9. SMS Terms & Conditions

  • Types of SMS Communications: Consented SMS updates may include dispatch status, driver location/ETA tracking, digital invoices, payment links, and follow-up communications.

  • Message Frequency: Varies depending on active service events (e.g., up to 5 messages per active dispatch window).

  • Opt-Out: Reply STOP to any text message at any time to opt out. Opting out may limit our ability to send real-time driver ETA and dispatch alerts.

  • Help: Reply HELP to any text message for support details.

  • Rates: Standard message and data rates may apply based on your mobile carrier plan.

10. Restrictions on Use & Proprietary Rights

All content on this Site—including graphics, logos, layouts, and copy—is protected by applicable copyright and intellectual property laws. You agree not to:
